Real Estate Contracts
In North Carolina, Real Estate Attorneys perform residential real estate closings. The real estate attorney in North Carolina is working for you to ensure that you are receiving the property free and clear of any encumbrances and that all the terms of the contract are met. Many buyers moving into the area are coming from states where Title Companies conduct the real estate closings. The process is quite different when a Real Estate Attorney does the closing.
Murphy Law Closing Process
- As soon as you go under contract, contact us to start your closing process.
- We ask that you or your realtor supply a copy of the sales contract to us so that we can determine that all the terms of the contract have been met before you the actual closing.
- We will perform a title search to make sure that the property you are taking title of is free and clear of any liens.
- You’ll then purchase a title insurance policy. Because we perform the title search, we will certify that the title is clear.
- We will order a property survey if you choose to have a survey done. We’ll review it for any encroachments that will be resolved before closing.
- We will prepare the HUD-1 closing statement to show how the funds will be disbursed at closing and how much money you will need to bring to the closing with you.
- At our office in Raleigh, NC, we will meet ordinarily with the buyers, the buyers agent, the sellers and the sellers agent to conduct the closing by reviewing with the buyer all of the loan documents provided by the lender and any other documents that are needed to complete the closing.
- After the closing is complete, we will take the deed to the appropriate ecourthouse to record it, and disburse all funds as indicated on the HUD-1 and return the required paperwork to the lender.
It is not uncommon in North Carolina that you don’t meet your closing attorney until you get to the closing, but rest assured, there is a tremendous amount of work going on behind the scenes on your behalf.

Contract Review: Addendum Preparation
How Do You Know If You Need Someone to Review A Contract?
In legal contracts, the wording and format have to be very precise to be legally binding. Working with an attorney like Murphy Law will ensure that your documents are legitimate, allowed in court, and are free of loopholes.
If you’re drawing up any legal document in North Carolina, you should bring an attorney on to review the materials, at a minimum. An attorney can also give guidance if you believe someone has infringed on a contract you’ve entered into or if you would like to get out of a contract.
What Should You Expect from Working with Murphy Law?
When your document is finished, you should expect that it is legally binding and will hold up in any court of law. We will make sure that you understand all of the terms you agree to and that you’re satisfied with the entire contract. If there are any issues with a document, we will clear them up, so the agreement works for you. With the use of an attorney, you can feel confident in your contract or agreement.
Residential Lease Option Contracts-buyer leasing prior to home purchase
Lease option sales first became a favorite financing tool in the 1970’s and the early 1980’s. They were used to avoid alienation clauses in mortgages, but they have some other benefits as well.
Today, options to purchase, lease options, and lease purchase agreements are three separate financing documents. They’re very similar, but they differ in the fine print. Working with Murphy Law will help you to better understand the implications so that you and your family can make the best possible decisions.
